Risk Disclosure

Read this before you use the daysim simulator and before you place any trade. If you do not agree with it, do not use it.
1. Not advice
daysim (the "Service"), operated by AVYX Labs LLC ("we", "us"), is a software simulator that runs statistical models on public market data and displays the results. It is not investment, financial, legal, tax or trading advice, and it is not a recommendation, solicitation or offer to buy or sell any security or to use any strategy. We are not a broker-dealer, exchange, investment adviser, commodity trading advisor or financial planner, and we are not registered as any of these with the SEC, FINRA, CFTC or any state or foreign regulator. The Service does not know your financial situation, objectives or risk tolerance and does not take them into account. Every output is impersonal and is produced the same way for every user.
2. You can lose everything you put in, and more
Trading stocks involves substantial risk of loss. Low-float, small-cap, recently listed and foreign-listed stocks, which the Service is designed around, are among the riskiest securities that trade. They can fall 50% or more in minutes, be halted for hours or days, reopen far from the last price, be delisted, or have their share count multiplied by a financing with no warning. Stop-loss orders do not limit losses during a halt or a gap. You can lose the entire amount you invest, and with margin, more than that. Do not trade with money you cannot afford to lose.
3. Simulated results are not real results
The odds, expected values, percentiles and "10,000 scenarios" shown by the Service are the output of a statistical model built from a stock's recent price history. They are hypothetical. Hypothetical performance results have many inherent limitations. No representation is made that any account will or is likely to achieve profits or losses similar to those shown. Simulated results do not reflect real trading, do not account for every market condition, and can be wrong. The model cannot foresee news, halts, offerings, broker restrictions, order-book conditions or liquidity. A plan shown with a 60% chance of profit is expected to lose 40% of the time, and losing runs of many trades in a row are normal with the model working as designed. Past performance of any kind, real or simulated, is not indicative of future results.
4. Data may be delayed, incomplete or wrong
Prices come from a free third-party source that is typically delayed about 15 minutes, may omit pre-market and after-hours trades, and may contain errors. Filing information comes from the SEC's public systems and may be late or incomplete. Halt detection is inferred from gaps in the price data and may miss halts or report ones that did not occur. Float, share count and market cap figures are estimates. We do not verify any of it. Never place an order based solely on a price shown in the Service; check your broker.
5. The Service does not trade for you
The Service does not connect to any brokerage account and does not place, modify or cancel orders. Any trade you make is made by you, through your own broker, under your broker's terms, at prices your broker gives you. Position sizes shown are arithmetic based on numbers you entered; they are not a recommendation of any size.
6. Rules that apply to you
You are responsible for knowing and following the rules of your broker, your jurisdiction and the markets you trade, including rules on day trading, margin, settlement, short selling and market manipulation. Some of the stocks the Service surfaces are the subject of promotions, pump-and-dump schemes or regulatory action. The Service's "pump profile" flag is a heuristic and is not a finding that any person has done anything unlawful.
7. Your responsibility
You alone decide whether to trade, what to trade, how much, and when to exit. You agree that you will not rely on the Service as the sole basis for any decision, that you will do your own research, and that you accept full responsibility for every trade and its results. If you do not understand any output of the Service, do not act on it; the Learn section explains every term, and you can contact us with questions.
8. No guarantees
We make no guarantee of profit, of accuracy, of availability, or of any result. See the Terms of Service for the full disclaimer of warranties and limitation of liability, which this disclosure forms part of.
